In accordance with the provisions of Article 10 of Law 34/2002, of July 11, Services Information Society and Electronic Commerce (hereinafter, ‘LSSI’), we inform you that the page www. ubadesign. com (hereinafter, the ‘Website’ or the ‘Portal’) is operated by UBA Design, with N. I. F. 02756914L.

Portal ussage.

This Legal Notice establishes the conditions governing the use of the information society services that UBA Design makes available to users of the Internet through the Website. The aspects related to the treatment of the personal data of the Users on the occasion of the use of the Web Site are regulated in the Privacy Policy.

In this way, the access and use of the Web Site suppose that the user, (hereinafter, the ‘User’), of the same accepts in its totality and is obliged to comply completely with the present Legal Notice, the Privacy Policy, as well as the instructions or recommendations that are indicated to him in each concrete case through the Web Site.

Access to the Website is free, except for the cost of connection through the telecommunications network provided by the access provider contracted by the User. UBA Design reserves the right to make, at any time and without prior notice, changes and updates of the Website and its contents, configuration and presentation, including this Legal Notice, so we recommend reading before each access and navigation through the Portal.

The User undertakes not to use the Website for fraudulent purposes, as well as not to carry out any conduct that could damage the image, interests and rights of UBA Design or third parties, being obliged to use the Portal, services and content included in the same diligently, correctly and lawfully. In particular, the User undertakes to refrain from: deleting, evading or manipulating the copyright and other data identifying the rights of their owners incorporated into the contents of the Portal, as well as the technical protection devices, or any information mechanisms that may include such contents. Likewise, the User undertakes not to carry out any act with the aim of damaging, rendering useless or overloading the Web Site, or in any way preventing its normal use and operation.

In the event that you breach this Legal Notice, or UBA Design reasonably suspects that you are breaching this Legal Notice, UBA Design reserves the right to limit, suspend or terminate your access to the Website, adopting any technical measures that may be necessary for that purpose. Likewise, UBA Design reserves the right to decide, at any time, on the continuity of the services provided through the Portal.

Intellectual and Industrial Property.

The intellectual property rights over the layout of the contents of the Website (including the sui generis right over the database), its graphic design (look &feel), the distinctive signs (brands and commercial names), the underlying computer programs (including the source codes), as well as the different elements that make up the Portal (texts, graphics, photographs, videos, etc. ) correspond to UBA Design, or it has, if necessary, the right to use and exploit them, and in this sense they constitute works protected by the intellectual and industrial property legislation in force.

The use of the Website by the User in no way implies the transfer of any intellectual and/or industrial property rights over the Portal, its contents and/or the distinctive signs of UBA Design. To this end, by means of this Legal Notice, except in those cases in which it is legally permitted, the User is expressly prohibited from reproducing, transforming, distributing, publicly communicating, making available, extracting and/or reusing the Website www. ubadesign. com, its contents and/or the distinctive signs of UBA Design.

It is expressly and strictly prohibited the reproduction of elements or contents of the Portal made for profit or commercial purposes.

Limitation of Liability.

The User acknowledges and accepts that the use of the Web Site is made at all times under his entire risk and responsibility, so that UBA Design is not responsible for any misuse or improper use that may be made of the Portal. To this end, it shall only be liable for any damages that the User may suffer through the use of the Website, when such damages are due to our wilful misconduct.

In particular, UBA Design will not be responsible for:

• The content of sites linked through the links included within the Website. In this respect, the terms set out in paragraph 5 of this Legal Notice shall apply.
• Damages of any kind caused to the User’s computer equipment by viruses, worms, Trojan horses or any other harmful element. The User acknowledges that the use of the Internet implies the assumption of a risk that their computer equipment may be affected by the aforementioned elements. For this purpose, it is the User’s responsibility, in any case, to provide adequate tools for the detection and elimination of harmful electronic programs, damages of any kind caused to the User by failures or disconnections in telecommunications networks that cause the suspension, cancellation or interruption of the service of the Website during the provision of the same or prior. In this respect, the
• User acknowledges that access to the Portal requires services provided by third parties beyond the control of UBA Design, (for example: telecommunications network operators, access providers, etc. ) whose reliability, quality, continuity and operation does not correspond to UBA Design.

Generalities.

The use of the Website is governed by and interpreted in accordance with Spanish law and it shall be understood that, by the use of the Portal, the User agrees that any conflict or dispute arising between the user and UBA Design will be dealt with by the competent courts and tribunals in accordance with the applicable legislation.

In the event that any of the provisions contained in this Legal Notice is declared null and void, it shall be withdrawn or replaced. In any case, this declaration of nullity will not affect the validity of the rest of the provisions contained in this Legal Notice.
